Terms of use
ARTICLE 1 - PURPOSE
1.1 These general conditions are intended to define the rights and obligations of the parties in the context of the online sale of Goods (hereinafter the "Goods") and services offered by TJMAX to the Buyer (hereinafter "the Buyer").
1.2 Any order implies the Buyer's unconditional acceptance of these General Terms and Conditions of Sale, which prevail over any other document, including any contrary stipulation on a purchase order or other document issued by the Buyer. These, along with the purchase order and possibly another agreement between TJMAX and the Buyer, constitute for the purposes hereof the "Contract".
ARTICLE 2 - ORDER
2.1 The Buyer places their order online after consulting the catalog available to them.
2.2 For the order to be validated, the Buyer must accept these general conditions by clicking at the indicated place on the site. They must also choose the delivery address and method, the billing address, validate the payment method and pay online.
2.3 The order will be confirmed by email at the latest at the time of delivery.
2.4 Any order implies acceptance of the prices and descriptions of the Goods available for sale.
2.5 In case of unavailability of the Goods, the Buyer will be informed as soon as possible and will also have the possibility to cancel their order. The buyer will then have the choice to request either a refund of the sums paid within 30 days at the latest from their payment, or an exchange of the product.
2.6 For any questions regarding the follow-up of an order, the Buyer must call +33 1 76 39 01 58 (Monday to Friday from 9am to 6pm, cost of a local call).
ARTICLE 3 - PRICE
3.1 TJMAX reserves the right to modify its prices at any time but commits to applying the current rates indicated at the time of the order, subject to availability on that date.
3.2 Prices are indicated in euros. They do not include delivery charges, which are billed separately and indicated before order validation. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of products in the online store.
3.3 Full payment of the price must be made at the time of ordering. Under no circumstances will the amounts paid be considered as deposits or down payments.
ARTICLE 4 - PAYMENT METHOD
4.1 To pay for their order, the Buyer has, at their choice, all the payment methods made available by TJMAX, namely: Visa, Mastercard, CB, and Paypal.
4.2 The Buyer guarantees TJMAX that they have any necessary authorizations to use the payment method chosen by them, when validating the order form.
ARTICLE 5 - DELIVERY AND RECEPTION OF GOODS
5.1 No delivery is made to campsites, hotels, poste restante, and post office boxes. The Goods are delivered to the address indicated by the Buyer on the order form, who must ensure its accuracy. Any package returned to TJMAX due to an incorrect or incomplete delivery address will be reshipped at the Buyer's expense.
5.2 Reception: In case of damage or non-conformity of the delivered Goods, it is the Buyer's responsibility to make all necessary reservations within 15 days of receipt by email to the following address: [email protected] or on plain paper to TJMAX at the following address: TJMAX LOUVRES, ZAC de la Butte aux Bergers, 9 avenue du Noyer à la Malice, Bâtiment A1 95380 LOUVRES. Failing this, the Goods are deemed to have been accepted as conforming and in perfect condition.
5.3 It is the responsibility of the Buyer who wishes to return the Goods for exchange or refund to send them within 15 days following their delivery to the following address: TJMAX LOUVRES, ZAC de la Butte aux Bergers, 9 avenue du Noyer à la Malice, Bâtiment A1 95380 LOUVRES. The goods must be unworn, unwashed, and in perfect resalable condition, with tags and in their original packaging. The Buyer should also include the invoice (or a copy) as well as the reason for return on plain paper. Upon receipt, TJMAX will replace the Goods or refund the purchase price if they are in perfect condition as specified.
5.4 The consumer may choose to refer the matter to, in addition to one of the territorially competent jurisdictions under the Code of Civil Procedure, the jurisdiction of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event.
ARTICLE 6 - WARRANTY OF GOODS
6.1 TJMAX guarantees the Buyer against all consequences of hidden defects in the goods sold in accordance with the legal texts in force.
6.2 The Buyer is expressly informed that TJMAX is not the producer of the Goods within the meaning of articles 1386-1 and following of the Civil Code relating to liability for defective products.
ARTICLE 7 - FORCE MAJEURE
7.1 TJMAX will be discharged from all liability in case of Force Majeure. In this context, "Force Majeure" means any event or condition that is not reasonably under its control and that prevents in whole or in part the performance of its obligations, including but not limited to decisions of a public authority, fire, strikes, shortage of raw materials and loss of export permits, etc.
ARTICLE 8 - PROCESSING OF PERSONAL DATA
8.1 TJMAX commits to comply with the legislation applicable to the protection of personal data in accordance with the Data Protection Act.
ARTICLE 9 - PARTIAL NON-VALIDATION
9.1 If one or more provisions of these general conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions will retain all their force and scope.
ARTICLE 10 - NON-WAIVER
10.1 The fact that one of the parties does not assert a breach by the other party of any of the obligations referred to in these general conditions shall not be interpreted for the future as a waiver of the obligation in question.
ARTICLE 11 - TITLE
11.1 In case of difficulty in interpreting between any of the titles appearing at the head of the clauses, and any of the clauses, the titles will be declared non-existent.
ARTICLE 12 - APPLICABLE LAW
12.1 These general conditions are subject to the application of French law.
ARTICLE 13 - CONDITIONS RELATED TO RETURNS
To be eligible for return, items must be returned in their original condition. The items must not have been worn or washed and must be in a condition that allows them to be resold. Returned items must be accompanied by tags, as well as any corresponding accessories and user manuals. No refund will be made if the returned items are incomplete, damaged or soiled.
A credit note will be automatically issued and will be available in the Credit notes and discount vouchers section of your customer account upon receipt of your package (subject to compliance with the return conditions specified above).
An email will be sent to inform you.
For both cases mentioned, this credit is valid for 1 year from receipt of the email and can be combined with current offers as well as Project X Paris gift cards.
If, however, you wish for a refund, simply reply to the email with I would like a refund.
The refund will be made directly to the payment method used for the order.
ALMA GENERAL TERMS AND CONDITIONS OF SALE
- The Seller offers its Customers the Alma credit service for the settlement of their purchases and the execution of payment. This is subject to the Customer's acceptance of the Terms of Use or the credit agreement proposed by Alma.
- Any refusal to grant credit by Alma for an order may result in its cancellation.
- Any termination of the General Terms and Conditions that bind the Customer and the Seller results in the termination of the Terms of Use or the credit agreement between Alma and the Customer.
- Payment in three / four installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
- Purchase amount :
- Only purchases between €100 and €2000 are eligible for payment with Alma
- Fees: By paying in installments with Alma, the Customer does not pay any fees.
- Alma is a tele-payment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code
- Termination: Any termination of the General Terms and Conditions that bind the Seller and the customer results in the termination of the Terms of Use between Alma and the customer.
Furthermore, only for payments in 5 installments or more (for example in 10 installments), also add to your general terms and conditions of sale (GTC) (in accordance with Article L312-45, under penalty of fine):
- The amount is paid by a credit granted by Alma SAS registered on the REGAFI under number 90876.
- Payment: Credit payment is available for the settlement of purchases via our partner Alma, the execution of payment is subject to signing the credit agreement proposed by Alma. The Seller accepts in advance the granting of credit concluded between Alma and the customer in accordance with article L312-46 of the Consumer Code. If Alma agrees to grant credit to the customer, the amount will be paid by credit in accordance with article L312-45 of the Consumer Code. Any refusal by Alma to grant credit for an order may result in its cancellation, unless the customer agrees to pay in cash. Any termination of the General Terms and Conditions that bind the Seller and the customer results in the termination of the credit agreement between Alma and the customer. In case of withdrawal, the fees and interest of Customers will be refunded in accordance with the regulations.
- Security: Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a tele-payment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code
- Special case : In the case of a sales contract or service provision with successive execution or delivered over fairly long periods, the Seller must specify in its T&Cs the moment when delivery or provision begins. For more details, you can contact the Alma teams at [email protected].
